That is not the rule.

The rule states Pagati members cannot rob something they kill for a hit unless the person they killed for a hit was knowingly and intentionally making it difficult to claim the hit.

This means if you surrender, you cannot be robbed.
If you run into a building and pull a chainsaw on the marker, you can be robbed.

In the case you show, he attempted a robbery, likely to either get wanted or because you're being a douchebag, but there is no rule against it as he clearly didn't claim a hit on you.
