You may use the Hunter against medium wanted suspects, highly wanted suspect or the most wanted suspect who are in the water or who are airborne.

I think you can in that situation since it says "who are are airborne" because it doesn't determine if a wanted is inside a vehicle or not, but only just if suspect is either on air or in the water.
